Sent to all new York Councillors in May 2015

Congratulation on your election. I wrote to each of the previous Councillors setting out how false and misleading information has been employed to support the Germany Beck planning application while testable evidence was ignored. I attach a copy of that letter (minus the detailed refutation, which I will be happy to send).I will be emailing each of the re-elected councillors to update them with the latest evidence and press for an urgent inquiry so that irreplaceable damage will not be done to York’s heritage and wildlife.

During the election, a young girl noticed the water voles along Germany Beck and the presence of this protected species has been confirmed by Council officers. On the previous occasions whenever I told the planning officers of the voles’ existence, the sites have been destroyed soon after. So last week I wrote to the Police to say that the circumstances were in place for a repeat of the criminal destruction of the vole habitats and asked them to be vigilant and warn the developers that their planned work would be illegal. But this should have been a matter for CYC.

There can be no question that the previous planning committee was aware that water voles inhabited Germany Beck because I told them that one had been spotted on the day of the reserved matters hearing when I was with Dan Snow making a film about the battlesite. I also provided the planning inquiry with pictures in 2006 and showed the inspector the evidence during the site visit.

You can check my website where I express my frustration to York’s Chief Executive because the officers were ignoring my information in 2009. The website also details the way the destruction of the habitat was investigated by the Police. I stopped providing notification of water voles because each time the habitat was destroyed. But these water voles are just one example of the way that the truth and the facts have not only been ignored but what looks to me like a cover-up of the archaeology. (I would be happy to send you documents sent to CYC). Something wrong has been going on. This is why an inquiry is so important.

The outgoing chief executive attempted to declare this matter closed but the water voles have ensured that the construction of an access road along Germany Beck is still an issue. The chief executive asserted that the case had been tested in the Courts. I would point out that the Courts recognised that I could be right about the facts, praised my work and recognised that I would be disappointed because the Courtis only concerned with the process. The law says it is CYC’s duty to check the facts. I have been telling them for 10 years that their ‘facts’ were wrong.

This should not be an argument between heritage or housing nor about wildlife-v-housing.  At Germany Beck these can all be accommodated. The real argument is about why the facts were not presented to the elected representatives, and this needs investigating. The law is clear – wildlife and heritage should have been respected and protected by CYC. We need an inquiry to discover why so much important information has been ignored.

I repeat the offers made in the attached letter to show you the ignored evidence which proves that Germany Beck is the site of the 1066 battle of Fulford.
